1. Introduction
BudgetHosting is a hosting department of EN Technologies Pte. Ltd.
This Acceptable Use Policy (AUP) governs the use of services (“Service(s)”) provided by EN Technologies Pte. Ltd. (“EN”, “we”, “us” or “ours”) to its customer via BudgetHosting, their customer (“End Users”), and any other entity using our Services. We have established this AUP to provide you with guidance about permitted uses of our Services. If you are purchasing our Services, either directly, or as an End User, it is part of your contract with us.
This AUP is designed to provide you with information about our policies should you believe that one of our customer, or their End Users, is engaging in conduct that is prohibited by law, or otherwise objectionable. Should you wish to contact us, please use the addresses listed in the appropriate section of this AUP. We are not required to respond to inquiries that do not follow this AUP.
2. Disclaimer
EN reserves the right to modify, update and/or materially change any of the terms and conditions cont- ained in this agreement without notice to customer. Any modifications are effective upon posting on EN Website ("Site"). customer shall periodically review the Site for any changes.
3. Suspension & Cancellation
Violation of this AUP, the policies of any upstream provider of EN, or the policies of any network connected on, to, from or through the Services may, at the sole discretion of EN, result in the immediate suspension or cancellation of any or all Services or other action deemed appropriate by EN, without remuneration to you. Any fees paid in advance of such suspension, cancellation, or other actions are non-refundable.
You may cancel your account anytime at your own will but there will be no refunds of any amount for any unused credits paid. Domains registered at EN can be transferred to any registrar by you upon termination of account.
4. Data Liability
You are solely liable and responsible for any and all data stored or transmitted on, to, from, or through the Services, including, without limitation, block special files, character special files, directories, symbolic links, socket links, fifos, regular files, programs, databases, text, graphics, pictures, movies, audio, streaming media, web pages, hyperlinks, email, instant messages, chat messages, file transfers, host names, and domain names.
5. Liability
You are solely liable and responsible for any and all damages or fines resulting directly or indirectly from violations of this AUP. Violations of this AUP may result in significant civil and criminal liability to you. Any attempted or actual violation of this AUP by any party on your behalf shall be considered a violation of this AUP by you.
You are responsible for the conduct of your customer and agree that your customer will adhere to the AUP. You shall make your current and prospective customer aware of this AUP.
6. Defination of "Unlimited" usage

b. Unlimited Domain Hosting EN does not set hard limit on number of domains allowed in each hosting account. There will be a soft limit of 50 domains of each hosting account. Domain names added after exceeding the soft limit must go through our Technical Support.
c. Unlimited Sub-Domain Hosting EN does not set hard limit on number of sub-domains allowed in each hosting account. There will be a soft limit of 200 sub-domains of each hosting account. Sub-domain names added after exceeding the soft limit must go through our Technical Support.
7. Prohibited Uses
EN reserves the right to decide as to what constitutes as abuse and any material not mentioned below is left entirely up to the discretion of our management and/or staff. Abuse can include, but is not limited to the following offences:
a. Spam - Unsolicited Emails
Sending of unsolicited email, newsgroup postings, chain letters and/or anything else that could be considered SPAM is strictly prohibited. This offence also includes the gathering of email addresses to be used for sending unsolicited email using a third party service. Account found violating will be suspended immediately, any damange to the account's IP reputation will be billed to the offending customer.
If a customer is found to be in violation of our SPAM policy, EN may, at its sole discretion, restrict, suspend or terminate customer's account. Further, EN reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation and will be charged to customer’s account. EN will notify law enforcement officials if the violation is believed to be a criminal offense. The customer acknowledges that he/she is responsible for any and all SPAM related actions which come from their account.

Customers are bound to all the Anti Spam Policy terms as listed in the Anti Spam Policy document.
Customers are not allowed to use our system to blast email to a mailing list. 3rd party services such Sendgrid are to be used for all mailing list emailing..
Customers are only allowed a MAXIMUM of 200 to 500 emails per hour from any individual hosting account of good standing and this maximum limit is depending on the account subscribed.
b. Copyright Infringement – Digital Millennium Copyright Act (DMCA)
The use of our Services requires that you honor and respect U.S. copyright law. You may not use our Services to infringe anyone else’s copyright, including the hosting of or direct linking to a torrent or warez site. While we understand that there are often differences of opinion about copyright law, the DMCA provides us with no discretion when an entity alleges copyright infringement.
c. Trademark Infringement
The use of our Services requires that you honor and respect U.S. trademark law. You may not use our Services to infringe anyone else’s trademark rights. Trademark infringement includes, but is not limited to, displaying another entity’s trademark on your website, using trademarked words in meta tags and other text based aspects of your website, and selling or distributing goods that you do not have a right to sell. For the avoidance of doubt, it is a violation of this AUP to use our Services to sell “grey market” goods.
b. IRC Chat Rooms
No connections to IRC or IRC-like servers or hosts may be made using our Services. IRC related programs, including, but not limited to, clients, bots, and servers, may not be run using our Services. You may not advertise or link to IRC servers using the Services.
e. System and Network Security
Any attempt to compromise a server or network device belonging to us and/or any other company, individual or entity is strictly prohibited.
f. File Sharing or Distribution
Allocated storage space is not allowed to be used for any mass file sharing or distribution to more then 10 parties.
g. Resource Abuse
Any website or scripts that uses higher then the top 5% of server resources (such as, but not limited to CPU, RAM, Network) in the whole server will be given reduce the resources usage or upgrade to a higher plan. Account with continued abuse will be suspended or terminated. Heavy resources script such as Magento, Chat Server, Real time connectivity scripts are not allowed in a shared hosting plan.
h. Backup Storage
Allocated storage space is to be solely used to host web sties and email only. Using an account as an online storage for archiving electronic files will result in termination of hosting services without prior notice.
i. Drugs and Online Pharmacies
No account may be used to engage in sales or distribution of prescripted or off the shelves medications or drugs.
j This offence includes, but not limited to:
i. Threatening harm to persons or property or otherwise harassing behavior.
ii. Sites or material or links of political nature.
iii. Scam and phishing site and material.
iv. Pornography and obscene site, materials or links.
v. Use or distribution of tools designed for compromising software, security or availability.
vi. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
vii. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
viii. Attempts to overload a system or broadcast attacks.
ix. Forging of any TCP-IP packet header or any part of the header information.
x. Intentionally or negligently transmitting files containing a computer virus or corrupted
Notifications regarding alleged abuse and/or copyright infringement can be sent to our abuse email: abuse@budgethosting.com.sg for further investigation by our staffs.
8. Bandwidth / Data transfer & Disk Usage
We do not actively monitor each accounts' bandwidth and data transfer usage, but does not it can be abused. As our customer are sharing the same resources, we will be investigating once there is a noticeable slowdown in services. If your account is found to be hogging up our bandwidth, we have the rights to set bandwidth trottling to ensure stability and fair use with all our customers. we may also require you to upgrade to a dedicated bandwidth or be contacted to work out a best solution with you.
We provide unlimited data transfer for all our plans and services. Data transfers for all accounts are not limited as long as contents does not contains Prohibited Uses materials listed above.
9. Email Resource Usage
Customers may not use resource exceeding their accounts' allocation. Depending on hosting package subscribed, customers are only allowed up to a MAXIMUM of 500 emails per hour from any individual hosting account. Accounts under investigation of AUP violations may be restricted from sending email.
Suspensions or service disruption may be made without prior notice.
If your account is bringing down our services, your account might be temporary suspended while we work with you to upgrade to a Dedicated Server / Virtual Private Server or be contacted to work out a best solution with you.
10. Accurate Information / Confidentiality
Providing us with accurate information not only makes it easier for us to contact you, but it also speeds our response to any complaints or issues you present to us. It is your obligation to provide accurate, updated, information to us.
Customer information is confidential. Third parties who contact us may request that their correspond-ence be kept confidential. However, our obligation to keep this third party correspondence confidential will only be pursuant to a mutually agreed-upon non-disclosure agreement, this agreement or law.
11. Cooperation with Law Enforcement & Revisions
EN may involve and will also fully cooperate with legitimate requests from law enforcement and other governmental entities in investigating suspected lawbreakers.
Report to us if you found any domains hosted by us in violation of our Acceptable Use Policy terms.
EN reserves the right to update / revise our Acceptable Use Policy at any given time without notifying you (the customer).
Customer is recommended to visit this page occasionally to check on any latest update on our Acceptable Use Policy.
